Business and Private International Law in the EU (Paperback)
Business and Private International Law in the EU (Paperback)
This book acts as a guide to companies doing business with parties in the European Union. It provides the reader with answers to key questions of private international law. When and under which conditions can the court(s) of an EU Member State assume jurisdiction and which law will be applied? Will the resulting judgment be recognised and enforced in other EU Member States? In addition to a general explanation of the system of private international law in the EU Member States, the book provides answers on questions of jurisdiction and applicable law in a selection of areas: the negotiation and conclusion of general contracts, consumer contracts, individual employment contracts, directors' liability and tort. Human Evolution and Development (Paperback)
Human Evolution and Development (Paperback)
Our understanding of human evolution is proceeding at an unprecedented rate over the last years due to spectacular fossil finds, reconstructions based on genome comparison, ancient DNA sequencing and new insights into developmental genetics. This book takes an integrative approach in which the development of the human embryo, the evolutionary history of our body, the structure of human populations, their dispersal over the world and their cultures are examined by integrating paleoanthropology, developmental biology, comparative zoology, population genetics and phylogenetic reconstruction. The authors discuss questions like: - What do we know about ancient humans? - What happens in the development of an embryo? - How did we manage to walk upright and why did we lose our hair? - What is the relationship between language, migration and evolution? - How does our body respond to the challenges of modern society? Turkish-Dutch and Moroccan-Dutch female professionals in social work (Paperback)
Turkish-Dutch and Moroccan-Dutch female professionals in social work (Paperback)
This qualitative research, carried out between 2012 and 2016 at the Utrecht University of Applied Sciences (HU) in the Netherlands, explores the experiences of newly-started Turkish-Dutch and Moroccan-Dutch female professionals in social work. The key research question was how these professionals perceive and position themselves in relation to their profession. The professionals were actively involved as co-researchers in parts of the research, doing research with peers from the same background. The last section of the research also discusses and explores the experiences of social work educators by including their perspective. The Turkish-Dutch and Moroccan-Dutch female professionals want to bring their cultural and religious background to bear on their work as professionals. They want to bring in faith and spirituality, as this is a source of strength and support for them, and attempt to stretch the 'boundaries' of what it means to be a professional. They would also like to see their

Integrated Environmental Permitting (Paperback)
Integrated Environmental Permitting (Paperback)
About the book Improving the quality of environmental law is high on the agenda of both the European Union and its Member States. In the Netherlands, there has been a series of changes of law in order to simplify and improve the complex and fragmented system of environmental law. However, the improvement of sectoral legislation has not led to the desired result. The Dutch legislature now considers a fundamental reform of environmental law necessary. One of the main goals is to achieve a coherent approach towards the physical environment in policy, decision-making and regulations. The Environment and Planning Act brings together 26 acts and about 120 governmental decrees in the area of spatiality and planning, infrastructure, nature and water, in order to create a single act for the physical environment. This book focuses on one of the key instruments of environmental law, the environmental permit. The integration of sectoral environmental permit systems is a way to simplify and speed

International framework agreements and fundamental social rights (Paperback)
International framework agreements and fundamental social rights (Paperback)
In an era of economic globalisation, the declining regulatory role of governments competing for investment and the rising power of multinational enterprises are leading to a race to the bottom in the area of fundamental social rights. This issue needs to be redressed. It is essential to promote fundamental social rights, at both national and international level, in order to give economic globalisation a more human face. At present, the advancement of social rights is mainly in the hands of the International Labour Organisation, the Organisation for Economic Cooperation and Development and the United Nations, which provide minimum labour standards that focus on governments and enterprises. Due to a lack of political will to develop legally binding agreements that directly address multinational enterprises, the implementation and recognition of fundamental social principles and standards throughout global supply chains are based mainly on soft law. In practice, social rights are largely

Insurance and Europe (Paperback)
Insurance and Europe (Paperback)
The Insurance Industry is increasingly influenced by European rules. Insurance companies in the twenty first century are active on the European Market as a whole, and national boundaries are less important. However, opinions differ with regard to the results obtained since the 1990's.1 A truly 'level playing field' seems to be absent; insurers and insured still face many difficulties when entering into cross-border transactions. Awareness of the effects of the developments of the European Insurance Market and the 'rules of the game' is of the utmost importance for the Insurance Industry. From this perspective, the Master Insurance Studies of the UvA Amsterdam Business School, in co-operation with the Open University of the Netherlands, the Netherlands Association of Insurers and the Netherlands Journal of Commercial Law (NTHR) organised the symposium 'Insurance and Europe' on Friday 23 November 2007. Its contributors were: Prof. dr. J.G.J. Rinkes (University of Maastricht/Open

Heritage and Rights of Indigenous Peoples (Paperback)
Heritage and Rights of Indigenous Peoples (Paperback)
The heritage of Indigenous Peoples has long been researched and commented upon from the outside. This book adopts an innovative approach by engaging with the heritage of Indigenous Peoples from the 'inside'. On 13th September 2007, member states of the United Nations adopted the UN Declaration on the Rights of Indigenous Peoples (UNDRIP), a momentous occasion marking wide political recognition of Indigenous Peoples' rights. Ten years on, this book explores the areas -both substantive and geographic- dealing with the heritage and rights of Indigenous Peoples globally. Written jointly by indigenous and non-indigenous scholars, the chapters offer an insight into the issues faced by Indigenous Peoples under the umbrella themes of land, spirituality and self-determination. The case studies - which span four continents - not only highlight the various resilient and imaginative ways in which Indigenous Peoples are managing to sustain, develop and transform their heritage, but also offer an

Unravelling unauthorized migrants' legal consciousness processes (Hardback)
Unravelling unauthorized migrants' legal consciousness processes (Hardback)
Nation-states turn themselves to 'the law' to limit the presence of migrants without a legal status on their territory. Yet, they encounter several limitations that hinder them to make these migrants (forcedly) leave the country. Moreover, these migrants see themselves confronted with undesirable living conditions because of the law. This raises questions on the functioning of the law for unauthorized migrants. Unravelling unauthorized migrants' legal consciousness processes offers answers to the intriguing puzzle of how law matters to these migrants and how this is of concern for the law. Drawing on multi-sited ethnographic fieldwork among 105 (former) unauthorized migrants in the Netherlands, Surinam and Nigeria as well as participant observations in the Dutch immigration system, the study vividly portrays unauthorized migrants' legal consciousness processes over time. By doing so, it gives these people a voice in the migration debate and sheds new light on the powerful and powerless
