Membership of the European Council in a Constitutional and Historical Perspective (Paperback)
Membership of the European Council in a Constitutional and Historical Perspective (Paperback)
Heads of state or government of the member states of the European Union have a dual role: they are and remain holders of domestic executive offi ces, but at the same time members of the European Council - the EU institution that is the centre of political authority within the Union. This membership, approached here from a constitutional and historical perspective, is autonomous to the extent that it is attributed to the heads of state or government and substantively determined by the EU's constitution. It is a key part of the EU structure and fundamental for comprehending the executive branches of the Union and of the member states as well as their relationship. The present study analyses the force of the duality that membership entails for the accumulation of authority within the European Council. It investigates for a number of member states - The Netherlands, Belgium and Germany - whether and how European Council membership has become compatible with and has affected domestic

Unravelling unauthorized migrants' legal consciousness processes (Hardback)
Unravelling unauthorized migrants' legal consciousness processes (Hardback)
Nation-states turn themselves to 'the law' to limit the presence of migrants without a legal status on their territory. Yet, they encounter several limitations that hinder them to make these migrants (forcedly) leave the country. Moreover, these migrants see themselves confronted with undesirable living conditions because of the law. This raises questions on the functioning of the law for unauthorized migrants. Unravelling unauthorized migrants' legal consciousness processes offers answers to the intriguing puzzle of how law matters to these migrants and how this is of concern for the law. Drawing on multi-sited ethnographic fieldwork among 105 (former) unauthorized migrants in the Netherlands, Surinam and Nigeria as well as participant observations in the Dutch immigration system, the study vividly portrays unauthorized migrants' legal consciousness processes over time. By doing so, it gives these people a voice in the migration debate and sheds new light on the powerful and powerless

The function of accusation in International Criminal Court (Paperback)
The function of accusation in International Criminal Court (Paperback)
The present survey aims to analyze the issue of the indictment function in the process before the International Criminal Court which integrates a peculiar justice system, result of the complex interaction between the juridical tradition of civil law and the juridical tradition of common law. The prosecution function is entrusted to a Prosecutor who is conceived as a hybrid figure. It is an organ that not only performs its functions in the context of a system in which the principle of opportune penal action applies, but which also operates on a level that can be defined to some extent as political, since he has to move in an international chessboard and being called to also have diplomatic relations with states and international institutions. The discussion (Chapter 3 and 4) proposes a non-new theme, such as that of the structure of the crime in the tripartite system, and yet almost transfigured by the impact with international criminal law, which opens up unexpected and unpredictable

Integrated Environmental Permitting (Paperback)
Integrated Environmental Permitting (Paperback)
About the book Improving the quality of environmental law is high on the agenda of both the European Union and its Member States. In the Netherlands, there has been a series of changes of law in order to simplify and improve the complex and fragmented system of environmental law. However, the improvement of sectoral legislation has not led to the desired result. The Dutch legislature now considers a fundamental reform of environmental law necessary. One of the main goals is to achieve a coherent approach towards the physical environment in policy, decision-making and regulations. The Environment and Planning Act brings together 26 acts and about 120 governmental decrees in the area of spatiality and planning, infrastructure, nature and water, in order to create a single act for the physical environment. This book focuses on one of the key instruments of environmental law, the environmental permit. The integration of sectoral environmental permit systems is a way to simplify and speed

CMR 60 years: time for retirement or future proof (Paperback)
CMR 60 years: time for retirement or future proof (Paperback)
On May 19 1956, the CMR-Convention was signed, aiming at providing uniform rules for the contract of carriage of goods by road. The Convention proofed to be very successful and is after 60 years still in force in 55 member states. With this, the Convention provides uniform rules in most of Europe and the Middle East and still contributes to the underlying aim of legal certainty and predictability. Even though the Convention is very successful, there are also a returning number of critiques on the CMR Convention. In general, critiques on the Convention can be found in two domains: 1. The absence of a uniform interpretation of certain key provisions of CMR (for example the scope rule, force majeure provision and breaking through rule). 2. The unfitness of CMR for twenty-first century transportation (for example the height of the limits, the absence of specific rules for multimodal contracts and optional carriage contracts, the outdated (?) rules on successive carriage and even the

Wegenkaart - landkaart Litouwen & Letland | ITMB
ITMB is very pleased to release its first-ever map of the Baltic country of Lithuania, which occupies Side 1 of this double-sided map. It is bordered by Latvia on its north, the Russian enclave of Kalingrad on its southeast, and Poland and Belarus on its south and east. It is now on the front lines of tension between Russia and its neighbours, as are all the Baltic states. It is also a valued member of both NATO and the EU, and as such is easy to access from either Poland or Latvia. Lithuania fronts on to the Baltic Sea with a major port at Klaipeda (formerly Memel), with its capital being Vilnius. Historically, the country has suffered German and Russian invasions during the 20th century, the last of which resulted in the country losing its independence completely by being absorbed into the Russian Empire in the latter stages of WW2. It regained its independence in 1991, with the collapse of the USSR and shortly thereafter applied to join both the European Union and NATO. Touristical…

Productomschrijving

This book acts as a guide to companies doing business with parties in the European Union. It provides the reader with answers to key questions of private international law. When and under which conditions can the court(s) of an EU Member State assume jurisdiction and which law will be applied? Will the resulting judgment be recognised and enforced in other EU Member States? In addition to a general explanation of the system of private international law in the EU Member States, the book provides answers on questions of jurisdiction and applicable law in a selection of areas: the negotiation and conclusion of general contracts, consumer contracts, individual employment contracts, directors' liability and tort. The integrated treatment of jurisdiction and applicable law for each of these subjects also makes the book an excellent guide to legal practice.
